Depth Chart Terms of Service

1. Agreement

These Terms of Service ("Terms") form an agreement between you and Nectarly LLC, a Colorado limited liability company ("we," "us"), governing your use of Depth Chart, the football career game at depthchart.nectarlyyours.com (the "Game"). By creating an account or playing, you accept these Terms. If you do not accept them, do not use the Game.

2. Eligibility

You must be at least 18 years old to create an account, and you confirm it when you sign up. The Game is offered only in the United States. While the Game is in testing, only invited email addresses can sign up. By creating an account you represent that you meet these requirements.

3. Accounts

One account per person. You are responsible for keeping your sign-in details private and for activity under your account. Tell us at support@nectarlyyours.com promptly if you believe someone else has used it.

4. The Game

4.1 Fiction. Depth Chart is a fictional football game. Its leagues, teams, players and results are simulated. It is not affiliated with, endorsed by or connected to the NFL or any real league, team or player.

4.2 No real money. The Game is free. Contracts, salaries and any currency inside the Game are fictional, have no cash value, and cannot be bought, sold or exchanged for anything outside the Game. If we ever offer paid features, we will publish terms for them before they are available.

4.3 Development and resets. The Game is under active development. We may rebalance ratings, change rules, restart seasons or reset leagues, and progress may change or be lost when we do. We will tell players in the Game before a planned reset.

5. Fair play

You will not: use scripts, bots or automation to play; run more than one account; exploit a bug for advantage instead of reporting it; choose a name that is offensive or impersonates someone; attempt to access another player's account or data; interfere with or disrupt the Game; or probe, scan or test its security without our written permission.

6. Names and content

You keep any rights you have in the names and text you put into the Game. You give us permission to store and display them in the Game, including on its public pages, for as long as they are part of the Game. We may change or remove a name that breaks Section 5.

7. Availability

The Game is provided as is. We do not promise any uptime, and features may change or be removed. We may do maintenance without notice, and will try to avoid game reveal times.

8. Suspension and termination

We may suspend or close an account for a serious breach of these Terms, or where required by law. Except where immediate action is needed, we will give notice and a chance to fix the problem. You may stop playing and ask us to delete your account at any time, as described in the Privacy Policy. Sections 6, 9, 10 and 13 survive termination.

9. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT PROGRESS OR DATA WILL NOT BE LOST.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, OR FOR LOST DATA OR LOST GAME PROGRESS, ARISING FROM OR RELATED TO THE GAME.

OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE GAME WILL NOT EXCEED ONE HUNDRED US DOLLARS.

11. Third-party services

The Game depends on third parties including Vercel, Neon, Resend, Google and GitHub. Their acts and omissions are not within our control.

12. Changes to these Terms

We may change these Terms. For material changes we will give at least 30 days' notice to your account email. Continued use after the change takes effect means you accept it.

13. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Game will be brought exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction. Nothing in this section prevents either party from bringing a claim in small claims court.
